2. Toepasselijkheid

Deze algemene voorwaarden zijn van toepassing op elk aanbod van SKIN.nl via de webshop op shop.skin.nl en op elke tot stand gekomen overeenkomst op afstand tussen SKIN.nl en een consument. Afwijkende voorwaarden gelden alleen als SKIN.nl deze schriftelijk heeft aanvaard.

3. Aanbod en totstandkoming overeenkomst

Elk aanbod op shop.skin.nl is vrijblijvend en kan worden ingetrokken zolang SKIN.nl de bestelling nog niet heeft bevestigd. De overeenkomst komt tot stand op het moment dat SKIN.nl de bestelling per e-mail bevestigt. Kennelijke fouten of vergissingen in het aanbod binden SKIN.nl niet.

4. Prijzen

Alle vermelde prijzen zijn in euro en inclusief btw. Verzendkosten worden apart vermeld voordat de bestelling wordt afgerond. SKIN.nl behoudt zich het recht voor prijzen te wijzigen; de prijs op het moment van bestelling is bindend.

5. Betaling

Betalingen verlopen via Shopify Payments. Beschikbare betaalmethoden zijn iDEAL en creditcard (Visa, Mastercard). Betaling vindt plaats op het moment van bestelling. Bij niet-betaling of terugboeking heeft SKIN.nl het recht de overeenkomst te ontbinden en de bestelling te annuleren.

6. Levering

Bestellingen worden verwerkt en verzonden door fulfillmentpartner 3bm.nl. Standaard levertijd binnen Nederland is 1 tot 3 werkdagen na bevestiging van betaling. Levering binnen de EU duurt 3 tot 5 werkdagen. SKIN.nl levert in elk geval binnen 30 dagen na totstandkoming van de overeenkomst. Als de levertijd van 30 dagen niet haalbaar is, stelt SKIN.nl de consument hiervan tijdig in kennis; in dat geval heeft de consument het recht de overeenkomst kosteloos te ontbinden.

7. Conformiteit en garantie

SKIN.nl garandeert dat de producten voldoen aan de overeenkomst, de in het aanbod vermelde specificaties en de redelijke eisen van deugdelijkheid. Op producten van Optimum Derma en HUBISLAB gelden de garantiebepalingen van de producent. Klachten over gebrekkige producten dient de consument binnen 2 maanden na ontdekking te melden via koen@skin.nl.

8. Aansprakelijkheid

De aansprakelijkheid van SKIN.nl is beperkt tot directe schade en maximaal het factuurbedrag van de betreffende bestelling. SKIN.nl is niet aansprakelijk voor indirecte schade, gevolgschade of schade als gevolg van onjuist gebruik van de producten. Deze beperking geldt niet bij opzet of bewuste roekeloosheid van SKIN.nl.

9. Klachten en geschillenbeslechting

Klachten kunnen worden ingediend via koen@skin.nl. SKIN.nl streeft ernaar klachten binnen 5 werkdagen te beantwoorden. Komt de consument er met SKIN.nl niet uit, dan kan een klacht worden ingediend bij het Europees Centrum voor Consumentengeschillen (ECC Nederland, www.eccnederland.nl). Het ODR-platform van de Europese Commissie is bereikbaar via ec.europa.eu/consumers/odr.

10. Toepasselijk recht

Op alle overeenkomsten met SKIN.nl is uitsluitend Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter in het arrondissement Amsterdam, tenzij de wet een andere rechter aanwijst.

2. Applicability

These terms apply to all offers made by SKIN.nl through the webshop at shop.skin.nl and to every distance-selling agreement between SKIN.nl and a consumer. Deviating terms apply only if SKIN.nl has accepted them in writing.

3. Offer and formation of agreement

All offers on shop.skin.nl are without obligation and may be withdrawn until SKIN.nl has confirmed the order. The agreement is formed when SKIN.nl sends an order confirmation by email. Obvious errors or mistakes in the offer do not bind SKIN.nl.

4. Prices

All prices are in euros and include VAT. Shipping costs are shown separately before the order is completed. SKIN.nl reserves the right to change prices; the price at the time of ordering is binding.

5. Payment

Payments are processed via Shopify Payments. Available payment methods are iDEAL and credit card (Visa, Mastercard). Payment is due at the time of ordering. In case of non-payment or chargeback, SKIN.nl has the right to dissolve the agreement and cancel the order.

6. Delivery

Orders are fulfilled and shipped by fulfilment partner 3bm.nl. Standard delivery within the Netherlands is 1 to 3 business days after payment confirmation. EU delivery takes 3 to 5 business days. SKIN.nl will deliver within 30 days of the agreement being formed. If the 30-day delivery time cannot be met, SKIN.nl will notify the consumer in a timely manner; in that case the consumer has the right to cancel the order free of charge.

7. Conformity and warranty

SKIN.nl guarantees that products conform to the agreement, the specifications stated in the offer and reasonable quality requirements. Products from Optimum Derma and HUBISLAB carry the manufacturer's warranty. Complaints about defective products must be reported to koen@skin.nl within 2 months of discovery.

8. Liability

SKIN.nl's liability is limited to direct damage and is capped at the invoice value of the relevant order. SKIN.nl is not liable for indirect damage, consequential damage or damage resulting from improper use of the products. This limitation does not apply in cases of intent or wilful misconduct by SKIN.nl.

9. Complaints and dispute resolution

Complaints may be submitted via koen@skin.nl. SKIN.nl aims to respond within 5 business days. If the consumer and SKIN.nl cannot reach an agreement, a complaint can be submitted to the European Consumer Centre Netherlands (ECC Netherlands, www.eccnederland.nl). The European Commission's ODR platform is available at ec.europa.eu/consumers/odr.

10. Governing law

All agreements with SKIN.nl are exclusively governed by Dutch law. Disputes will be submitted to the competent court in the Amsterdam district, unless the law designates another court.
